Motor Vehicle Accidents

Motor Vehicle Accident Claims
Motor vehicle accidents can result in both physical and mental injuries. In some cases those injuries have long lasting effects on your health, happiness and ability to work. Strict time limits apply in NSW to motor vehicle accident claims, so if you have been involved in a car accident, speak with us as soon as possible.
It isn’t only the driver of a car involved in an auto accident who can claim. You can claim if you were a passenger, a pedestrian, a cyclist or a pillion passenger on a motorbike if you’re injured in a motor vehicle accident.
If you’ve been very seriously injured, you may be able to claim regardless of who was at fault. Very serious injuries include:
- Spinal Cord Injury
- Brain injury that is moderate to severe.
- Blindness
- Multiple Amputations
- Severe Burns
The first step is to establish who the insurer is for the car that you think was most at fault. If you’re not sure, we can find that information for you. Where there is no at-fault driver or they can’t be found, for example in a ‘hit and run’ scenario, you can claim through a nominated insurer known as the ‘Nominal Defendant’.
Once you have contacted the insurer, you can claim for:
- Income support payments if you’ve sustained injuries that mean you can’t work for a period of time.
- Immediate payment of medical expenses and loss of income of up to $5,000.
- Potential payment of future medical or rehabilitation expenses.
- Lump sum payments if you’ve sustained serious injuries that meet a certain threshold.
- Compensation for a dependent relative if the accident caused a death.
- Funeral expenses if the accident caused a death.
- Special benefits for children injured in motor vehicle accidents.
The insurer may want to settle the claim as cheaply as possible. Our experienced auto accident lawyers will be able to advise you whether their offer is adequate and help you fight for more.
If your claim is denied by the insurer, there are several avenues you can pursue. These include opening a dispute with the insurer directly. Otherwise, you can contact the Medical Assessment Service MAS or the CARS for help. Some matters can be resolved at this stage while others may need to go to Court.
